What Is Civil Law?

Civil law governs disputes between individuals, businesses, or organizations where one party believes they have been wronged or injured by another. Unlike criminal law, which involves offenses against the state and potential punishment such as jail time, civil law focuses on resolving conflicts and providing compensation or other remedies to the injured party.

The goal of civil law is not to punish, but to restore balance—to make the injured party “whole” again through financial damages, injunctions, or court orders.

Civil law covers a broad range of legal issues, including:

How the Civil Legal Process Works

A civil case typically begins when one party (the plaintiff) files a complaint against another (the defendant), outlining the harm suffered and the relief sought—such as payment for damages or an order to stop certain actions.

Both sides then have an opportunity to present evidence, exchange information during discovery, and attempt settlement negotiations. If no resolution is reached, the case proceeds to trial, where a judge or jury decides the outcome.

The Purpose of Civil Law

Civil law provides a structured way for people and organizations to resolve disagreements fairly. It ensures accountability, upholds contracts, protects personal rights, and promotes trust within communities and commerce.

While many civil cases are settled outside of court through negotiation or mediation, having the option of formal litigation ensures that justice remains accessible when other methods fail.
